Document 27628 FRANKLIN D. ROOSEVELT Eight days after the Senate voted to kill his federal judiciary reorganization bill, the President writes about it. TLS: "Franklin D. Roosevelt" as 32nd U.S. President, 1p, 7x9. The White House, Washington, 1937 July 30. To Alexander G. Grant, Jr., Baltimore, whom FDR addresses as "Zee". In full: "Thank you much for your letter. I had no idea that Bill was coming out in the Senate. I hope you will read the debate that took place on it. The difficulty in the Senate lay, I think, in the fact that the proponents of the Bill seemed to have most of the arguments and there was little answer given on the other side of the case. The Bill has not been reported out by the House Committee. I hope to see you one of these days." On February 5, 1937, President Roosevelt had sent a message to Congress recommending the revision of statutes governing the federal judiciary. Although the recommendations were intended to provide more efficient and younger judges in all federal courts, Roosevelt was charged with attempting to pack the Supreme Court with more Justices (which would be his appointees, of course). At the time, three Justices were in their 60s, five were in their 70s and one was 80, and they had declared important parts of FDR's New Deal legislative program unconstitutional. On July 22, 1937 the bill came out of committee and was voted on by the Senate, which returned it to committee by a vote of 70-20, effectively killing it.
